In one of Malaysia's first cases under the Geographical Indication Act 2000, Tay & Partners scored a victory for client Kraft Foods, in relation to the Swiss mark used by defendant Maestro Swiss chocolates. The Court of Appeal held that Kraft Foods had a valid case in respect to the goodwill and reputation of renowned Swiss chocolates, ruling that Maestro Swiss could not use the Swiss mark because they were not produced in Switzerland.
