Horten is a tier 1 patent contentious firm and a tier 2 trade mark/copyright contentious firm. The firm's IP team is highly experienced and large, with seven partners and nine other lawyers. Based in Copenhagen, the firm has strong clients from the pharmaceutical, life science, telecom, media, retail and food sectors. "The main guy is Ole Damsbo and it gets a lot of cases," one rival says. "It is often used for referrals."
Jens Jakob Bugge has been involved in high profile trade mark litigation in Denmark. The trade mark Tivoli is a Danish superbrand and Montana is a very well-known Danish manufacturer of furniture. Montana used the designation Tivoli for a chair without prior consent and Bugge advised Tivoli on the question of whether it was trade mark use or title use. The case was appealed to the Supreme Court. The firm is also acting for Actavis before the Supreme Court in a case initiated by Lundbeck. The case concerns the generic version of escitalopram.
